I was riding with my boss once and he was on the cell phone yelling at another employee. On city streets, the driving was about average and comparable to a driver preoccupied with smoking, eating/drinking or applying make up.

However, once out on the freeway, the driving became much worse! It was obvious the driver was no longer concerned with watching for traffic signals or the proximity of other vehicles... His only concern became the argument on the telephone until he suddenly noticed he was about to pass the correct exit, slammed on the breaks and nearly wrecked into an 18 wheeler truck!

If I'm not mistaking, I believe wreckless driving is already illegal? Surely my boss would have been pulled over had a cop witnessed such unskilled operation of a motor vehicle.

So I think phone driving laws are rather redundant, much like hate crime laws... It's illegal to murder a person regardless if you love them or hate them! It's also illegal to drive wrecklessly, weather you're making a phone call or stirring your $5 cup of coffee.

If you are making a phone call and run over a kid on a bike, it's not the phone that killed the kid, it was you and your wreckless driving... More directly, the car itself is the instrument of death but the driver and their disregard for human life are to blame.

I wonder if anyone has ever done a study to see what directly kills more people... Motor vehicles, heart disease, cancer, etcetera?
